Scott Peterson's defense team continues to sort through thousands of pages of
discovery... trying to put together a defense that will save Peterson's life as he
faces capital murder charges in the deaths of his wife and unborn baby boy.


Scott Peterson was unexpectedly back in court Tuesday as the judge called a
rushed hearing to deal with the
unsealing of the search warrants in the case.
No cameras were allowed in the courtroom, and the matter has been
continued until Friday. This has the defense team starting to take shape.


Last week Scott Peterson was in jailhouse orange and represented by a public
defender. This week he's in a suit and has begun compiling an impressive
defense team, brown said.   "I don't believe Scott Peterson murdered his wife
or his child,"  said Mark Geragos, Peterson's attorney.


Legal expert, Peter Keane, says Geragos' media savvy may be his downfall.

"I think the big challenge for Geragos right now is to not do what he always does do,
and that is, he has to got to make his client and himself disappear from the public
perception," said Keane, of Golden Gate Law School.  Keane says the addition of
Peterson's original attorney Kirk McAllister is key to the defense.


"Mark Geragos and Scott Peterson asked me to come back and help fight these
charges," McAllister said.  A former local deputy district attorney that law
enforcement turns to when they need help, McAllister knows the legal
landscape of Modesto.  And Geragos has also brought on board private
investigator Bill Pavlik.  "We are still in infancy stage, making assessments
on it," Pavlik said.


He played a key roll in the OJ Simpson defense -- providing the information
that helped to discredit LAPD Detective Mark Fuhrman.


"The OJ Simpson case is associated in the public mind with all sorts of
negative things so to bring in the investigator who was used in the OJ
case in my opinion is not a good idea," Keane said.


But Peterson's family stands behind Geragos' decisions, hoping the man who
disparaged their son as a TV commentator, will as an attorney, be able to
save his life, Brown said. The
prosecution says no matter who is on the
defense team; it will not change how they try their case. They say they have
a strong case that warrants the death penalty, Brown reported.
