Judge threatens jail for those
not responding to subpoenas

The judge in the Scott Peterson murder trial threatened to put a handful of people in jail this morning
after defense attorney
Mark Geragos said they had failed to respond to subpoenas he had issued.

Representatives from Pacific Bell, United Parcel Service and Federal Express ignored requests
to produce by this morning documents Geragos asked to be turned over, the lawyer said.


Judge Alfred Delucchi immediately allowed Geragos to take steps to enforce the subpoena.

"If they don't show up with the information ... they'll be taken into custody," Delucchi said.
"It might be worth a phone call to tell them that's exactly what's going to happen."


Geragos did not say what the documents showed or why they were relevant to the case.

Lawyers on both sides have the power to subpoena witnesses and possible evidence. The
requests are backed by the enforcement power of the court, which Delucchi exercised today.


Failing to follow a subpoena could lead to arrest on a contempt of court violation.
Bail would be set, Delucchi said, and the cases would be prosecuted.


Geragos has argued that police botched the investigation into the disappearance and murder of
Peterson's wife Laci, 27, and the Modesto couple's unborn
son. He has asked for and received
thousands of pages of documents from police and other law enforcement sources that he said
will help reveal systematic problems with the investigation.


Prosecutors have said they handed over all of their documents. But
records from private companies are not controlled by prosecutors
