The family of Scott Peterson and his attorney,  Mark Geragos, announced Monday
they would not only prove the  Modesto man did not kill his wife and unborn son,
but that they  would
also find the person who did.

Speaking outside the Stanislaus County courthouse, Geragos went on the
offensive for the first time since taking over Peterson's defense on Friday.


"We have set the bar extremely high," the famed Los Angeles  defense attorney told
reporters. "That's to prove that Scott is not  only factually innocent, but to figure out
exactly who it is who did this  horrible thing to Scott's wife and Scott's son and to their
grandson. That was their mantra to me when they first came into the office."


"To all of the people who had doubts about this, that or the other thing in
terms of comments being made, the people who know him  the best are standing
behind him 100 percent and they believe in this young man's innocence."


"They've turned my head around and I think it's only a matter of
time (before) we're able to turn America's head around."


Earlier, unshackled and wearing a tailored business suit instead of
red jail jumpsuit, Scott was back in a Modesto courtroom for the
first of two hearings scheduled for the day on issues involving the case.


Geragos argued that Judge Al Girolami should removed himself from
hearing the case because a second judge had been assigned to decide a
civil petition that sought the release of the eight search warrants issued
during the police investigation and their supporting documentation.


The defense attorney said having the case in two different courtrooms was contrary
to normal procedures. Girolami disagreed and denied the petition. The judge did
approve the addition of
Kirk McAllister, a Modesto attorney who represented
Scott earlier in the case, to the defense team.

Moments later, in a courtroom across the hall, Geragos and McAllister were successful
in convincing Judge Roger M. Beauchesne to keep the warrants
under seal.

Geragos argued that keeping the arrest and search warrants sealed
would prevent his client's defense from being harmed.


Geragos said he hasn't seen the records, but suggested they could include
references to "psychics and voice stress analysers, all of  which are totally
inadmissible. If any of these things make their way into applications for
search warrants and arrest warrants," he said,  it would be prejudicial to
Peterson. Geragos made the remarks during one of two hearings Monday
in Stanislaus County Superior Court in Modesto.


Peterson had met with Geragos and McAllister for five hours on Sunday including the
time when a public
memorial was being held for his wife, Laci, and unborn son, Conner.

Peterson's mother, Jackie, of San Diego, also told reporters after
the hearings: "Our son is innocent, and we once again feel the truth
will come out. We have faith in the legal system."


Peterson wore a dark blue suit for his third court appearance in19 days, replacing the
chains, sandals and one-piece jail jumpsuit he wore for earlier hearings.
