Peterson case judge is
asked to punish prosecutors

-- An attorney for Scott Peterson asked
a judge Monday to punish prosecutors
-- possibly by removing them from the
case -- for eavesdropping on phone calls
between the accused killer and his lawyers.


Peterson's lawyer Mark Geragos, in a
motion filed with the judge in the case,
also urges that evidence obtained
through
wiretaps of the fertilizer
salesman's phones be suppressed and
that defense attorneys be allowed to
question Stanislaus County District
Attorney's Office investigators.


Geragos also suggested in the motion
that the "grave prosecutorial misconduct"
of intercepting privileged communications
between a defendant and his attorneys
could be grounds for dismissing the charges.

New developments in the Laci Peterson case.

A source within Scott Peterson's defense
team is putting a potential
name to Laci's killer.


This comes on the heels of a possible gag
order being issued in the case later this week.


While Scott Peterson's defense team
searches for the mystery man who may
know something about Laci's death,
there are reports that Scott's alibi may
not be as tight as it seems.


A source says Laci's sister is claiming
she cut Scott's hair the day before
Laci disappeared.


She says he told her he would be golfing
the next day, not fishing.


Meanwhile, the controversy continues
over
Laci's family taking some of her
things out of the Peterson's Modesto home.


The defense team is suggesting the Rocha
family was
breaking and entering
to plant evidence.


The theory about a mysterious man
named Donnie driving by the house
in a van on Christmas Eve comes on
the heals of another involving a
satanic cult.

Detectives working this case are
apparently angry about both scenarios.


T
hey say Peterson's defense team is
taking aim at the investigation and
the detectives themselves.


That's why talk of a gag order on
this case is intensifying.


"The gag order will definitely reduce
the theatrical nature of the information
we are getting. We will no longer have lots
of sensational comments being made in
front of microphones by the attorneys or
the investigators," said Fox News
legal expert Stan Goldman.


A judge is expected to decide on that gag
order Friday along with whether or not
autopsy reports should be made public.

On Tuesday, a decision is expected to be
made on whether to unseal search warrants.
