Geragos is expected to file a change-of-venue motion

During a hearing set on the motion May 11, Geragos is set to present data showing that a high
"prejudgment rate" exists in the County, along with information regarding alleged stealth jurors.


A juror who was excused Monday, April 26, 2004, talked to reporters afterwards.
Geragos plans to use her as ammunition to get a change of venue, saying that another
so-called stealth juror might have surfaced during jury selection Monday.


Mark Geragos told Judge Alfred Delucchi that Juror 29774 told a reporter outside the courthouse
on Monday that she believed Peterson was guilty. She said in her jury questionnaire, however,
that she was not certain about whether Scott was guilty of killing his wife and their unborn son.


Juror No. 29774 - A retired Hispanic woman with shoulder length brown hair was excused when
she stated that given the crime, if Peterson was guilty, she could only vote for the death penalty.


This juror's questionnaire stated that she had not formed an opinion and could be fair, but when she
sat through voir dire, she was dismissed for saying that she would only vote for the death penalty if
she found Peterson guilty of murdering Laci and Conner. However, when  reporters caught up to
her leaving the courtroom, she stated on camera (pool video) that Peterson was guilty. This juror's
flip to stating opposing opinions from what she wrote on her questionnaire lead Geragos to state
to the court for the record that this pool video will be used in his argument for the change of venue.
