| Tuesday, May 25, 2004 Defense Accuses Peterson Trial Prosecutors Of Misconduct FULL STORY By Bay City News Service Scott Peterson's attorney has accused prosecutors of misconduct for allegedly hiding one witness and tampering with a second one. Defense attorney Mark Geragos filed a motion on Monday seeking sanctions from Judge Alfred Delucchi for the alleged misconduct. The specific sanctions Geragos is seeking were not included in the portion of the motion made public by the judge. Geragos claims that prosecutors only turned over information last week about a potential witness that claims to have seen Laci Peterson being pulled into a van by two men despite having known of the witness's existence since December 2002. "Just last week the prosecution turned over reports disclosing an interview with a witness who saw Laci Peterson being pulled into a van by at least two men. This eyewitness, who has been a sworn police officer, has apparently been known to the prosecution since December 2002 yet he was only interviewed within the last week,' Geragos' motion said. 'However, the Modesto Police Department chose to ignore this former peace officer's report-presumably because 'it was not going in the right direction.'' The motion also claims that prosecutors tampered with witness Diane Jackson by having her hypnotized by an unqualified hypnotist named Dale Pennington. 'The prosecution's improper utilization of Dale Pennington is tantamount to the destruction of evidence because it has rendered a key percipient witness technically unavailable to Mr. Peterson,' according to Geragos' motion. Deluchhi ruled in February that Jackson's testimony would not be allowed at the trial because Pennington was not a qualified hypnotist. Jackson allegedly saw a number of men standing next to a van outside the Peterson home on Dec. 24, 2002, the day Laci Peterson was reported missing.
