ANOTHER VENUE CHANGE???

Mark Geragos  has yet to file a motion asking a judge
      to move the double-murder trial of Scott Peterson a second
      time, despite saying those documents would be filed Monday.


He said last week he planned to ask for a range of remedies to counter alleged bias against his
client from potential jurors. Those steps include moving the trial a second time, having a separate
jury decide whether Peterson should be executed if convicted or giving the defense extra
challenges during jury selection, Geragos has said.


Judge Alfred Delucchi had set Monday as the filing date. Prosecutors were supposed to file their
responses to the defense today. The judge scheduled court to convene early Monday to hear the issue.


"They have not received any filings from Geragos as of (Thursday)," Chief Deputy
District Attorney John Goold said. "I don't know what to tell you."


Geragos contends publicity has continued unabated since the move to the Bay Area. He has
made no secret of his desire to move the trial to Los Angeles, where his law firm is.


Despite missing Monday's filing date, Geragos still could request moving the
trial a second time. Prosecutors are expected to oppose any such bid.


Jury selection  is on hold until Monday, March 22nd.

This  will gave lawyers time to review questionnaires filled out by potential jurors. Hundreds of
candidates have filled out the 116-question document designed to weed out potentially biased jurors.


The first of 317 prospective jurors not already excused from the case are scheduled
to appear Monday  for individual questioning by the judge and attorneys.


According to defense attorney Mark Geragos, so far, the questionnaires reveal that a lot of
people already seem to think that Peterson is guilty. The defense says the bias may be
grounds to move the trial to Southern California.


Also, a fight is expected to begin on Monday,  over the admissibility of television
interviews given by the defendant before his arrest.


Delucchi has to decide weather to uphold the defense's motion
to prevent the interviews from being introduced as evidence.
