Judge To Consider
Search Warrant Release

A Modesto judge will consider whether search warrants in the Scott Peterson
case, should remain sealed. A
hearing will take place at 8 a.m. Tuesday.

Meanwhile, Peterson's defense team is trying to get prosecutors removed from the case.
Peterson's lawyers filed a motion Monday, asking a judge to replace Stanislaus County
district attorney
Jim Brazelton and his staff. Mark Geragos says prosecutors illegally
tapped phone conversations between Peterson and another attorney.

Among the conditions suggested by the motion are:
-The recusal of the District Attorney's Office and the total screening of the new prosecutor from
any communication with the DA's office and its agents or investigators involved in the wiretap.


-Exclusion of testimony of investigators or attorneys involved in the wiretap.

-Exclusion of evidence the government cannot demonstrate was not the "fruit of eavesdropping.

What's Geragos worried about? If he finds the 'real killers'
why would anything Scott said on the phone be a threat?
