Peterson's defense attacks
prosecution evidence

October 20, 2004

Scott Peterson's defenders went on the attack Wednesday, taking aim at key
prosecution evidence of Laci Peterson's walking routine, her scent at the
Berkeley Marina and the police investigation that brought it all together.

In a day abbreviated by closed-door discussions, Los Angeles attorney Mark
Geragos once again pointed to a tip that Laci was seen walking in her
Modesto neighborhood just two weeks before she disappeared.

According to Kevin Bertalotto, an investigator with the Stanislaus County District Attorney's
Office, Chris Clark said in April that he specifically saw Laci walking a golden retriever
about two weeks before she vanished. Clark,  who has a substance abuse problem and was
arrested three times on suspicion of drunken driving, told Bertalotto he was working at
the home of his boss, Carl Williams, who lives near the Petersons.  He is the stepfather
of
Kim McGregor, who burglarized Laci Peterson's home after she disappeared.

Bertalotto said Clark knew the woman he spotted was Laci because he
saw her face on television news programs after she disappeared. He did
not come forward, he said, for fear of being ridiculed in the media.

Prosecutors have suggested Laci had stopped walking before disappearing Dec. 24, 2002
and could not have been abducted while strolling that day as her husband theorized. She was
eight months pregnant at the time and had become sick on prior walks, witnesses have said.

Peterson told police his wife planned to walk after he left on a solo fishing trip to San Francisco
Bay. He returned home later that day to find the family dog in the backyard, but no trace of his wife.

He suspected someone - perhaps transients - had kidnapped his wife.

Police investigators had a different theory, however - one that put the blame solely
on Peterson. He killed his wife either Dec. 23 or 24, 2002 and drove her dead body to the
Berkeley Marina where he launched a small fishing boat to finish off his crime, police have said.
