Schweitzer said he was in an unmarked police car, but Peterson was aware he was being followed. At one point, Peterson drove up and stopped next to Schweitzer's car and "asked me what agency I was with, state or local.'' Schweitzer said he replied: "I don't know what you're talking about.'' |

| Late in the morning of April 18, 2003, Scott Peterson was arrested at the intersection of Callan and Torrey Pines Road in the San Diego area. The arrest was made by Department of Justice Special Agent Supervisor Ernie Limon, Special Agent Peter Shear and CHP Officer Claude Jubran, without incident. He was immediately turned over to Modesto Police Homicide Detectives. Scott Peterson was transported back to Modesto to be booked into the Stanislaus County Public Safety Center. | September 30, 2004 Five undercover agents from the state Department of Justice testified Thursday afternoon about their surveillance of Scott in April 2003 in San Diego, leading up to the day of his arrest near a San Diego golf course. Peterson apparently knew he was being followed, and at times drove up to 75 mph in a 35 mph residential zone during the surveillance that was supposed to be covert and included a caravan of unmarked police cars, agents testified. At one point, Peterson raised his hands to clap, as if to applaud the officers who managed to stick with him despite his maneuvers that included abrupt lane changes, U-turns, and stops. Soon after his arrest on April 18, 2003, Peterson approached one of the officers who had followed him during a high- speed chase that nearly caused her to be in an accident. "He apologized to me,'' special agent Sonia Ramos, of the San Diego unit of the state Department of Justice, testified Thurday afternoon. Peterson told her he thought she was with the media, Ramos testified. Ramos was part of the caravan that followed Peterson on the day of his arrest. "He watched and smiled at me as I drove by,'' Ramos said. She found $10,000 in cash in a white envelope in Peterson's car and $285.20 in his pocket. Agent Peter Shear testified that Peterson drove "at pretty excessive speeds and at times, very slow so that other cars would have to go around him. '' Peterson would get off an exit and get back right on; on residential streets, Peterson would make U-turns. Shear followed Peterson on the day of his arrest, April 18. The surveillance started at around 6 a.m., when Peterson drove away in his burgundy Mercedes-Benz. At one point, the agent lost Peterson for about 15 minutes, and then found him again in the Ocean Beach area of San Diego. As he did with other agents, Mark Geragos asked Shear if Peterson had tried to escape at any time during the surveillance. "Did you at any time see him make a break for the border of Mexico?'' Geragos asked. Shear said he did not. Ernie Limon supervised Peterson's surveillance in San Diego as well as the collection of dog hair from McKenzie for analysis. During his cross-examination of Department of Justice Agent Limon, Geragos asked about the time the officer collected evidence from McKenzie, the Petersons' Golden Retriever. Limon was one of five law enforcement officers involved in serving the search warrant at Scott Peterson's brother's house in San Diego. The task involved plucking hairs from McKenzie. "When you were plucking the hairs out,'' Geragos asked,"did the dog bark at you?'' Limon paused before responding: "I don't recall.''
